I agree about the confusion (it's close to a "brain freeze") but often the main purpose of lawsuits is for total confusion of attorney's, judge's, jury' involved using it as a ploy to get something else - they know they can't get 500 mil from CYGX.
There numerous reasons of which some on the board have speculated on.
-To extend an option or get money or just in on the action - The "hanger-on-type". This can only be paid in shares in this case, we know that.
-or perhaps the unthinkable - just plain stupid people involved in this case (cases). LW can lose his cool but could he make such an insulting and damning statement (I don't want to speculate on this possible quote by LW).
-There would have to be stronge evidence in this case as you have pointed out i.e. tape recording on a phone if legal in Texas for evidence as I believe it is legal in New York (one way permission to record on the phone) or by a witness(es) in the room.
-Agreed, why didn't CYGX do complete DD on PP? Is CGYX so impressed with names, that they will jump into deals (or whatever) without examining what the partner(s) in business can really do. Its not that difficult to do.
-Yes, why hasn't CYGX disclosed much more information regarding where the clinical research on HVS has progressed to date. Back to that chronic communication problem. And please all, remember that the statements on HSV what were to be given out in 30 days over a year ago, never were revealed and CYGX lost the exposive PPS advancement it was making upward (look at a chart and news releases from CYGX at that time). This is just a plain fact!
-and so on - most posts have stated the options and I do begin to feel it's a waste of time guessing at the possibles. But we should speculate. Confessed?
Basically, I'm not impressed with the case as it has presented to date - perhaps there is more to come?
I don't think the courts will be impressed, unless there is some HARD and damning evidence to come.
Lets not condemn anyone one posting other than "I don't agree and please state why - the person you are condemning may have one of those "possibles" that just be correct or close to it. i.e ARNOLD once condemned by a few and now......no need to go further.........excellent!
This poor guy who designed the PP web site was being telephone to some degree by shareholders/posters and this was stated sometime ago, by their own admission.
The web-designers "last" post (hope it is) did release alot of detailed information but I sure he could have gotten the details by the callers. Perhaps he was interested in CYGX from the positive reviews of the callers?
Someone regested going to a shareholders meeting and doing a face to face with management - that seldom works out - its a good idea but perhaps you could do it.
Again management does read the board - but if one were to confront them with this fact, they (CYGX) would protest strongely with great tones of negatives and put-downs. You could be told, that the way a company like CYGX will succeed, is to paid for advertisements such as we have been exposed too. Kind of "tacky" but I could be wrong.
Maybe the ligitation will expose CYGX to the world(?).
Wait a minute, I thought this was a bio-tech company!
Nevertheless, CYGX must get their act together soon and begin to communicate with the real world if they hope to be successful. The science is great but it must be presented to the "real-world".
Now that I am more confused than when I started reading the posts, I must retired with a major "brain freeze". Maybe things will flaw out tommorrow. Yes, thats it, I'll think about it tomrrow.
