Perhaps that's the excuse Paul Otellini should have used, instead of:

Intel Chief Executive Paul Otellini denied any wrongdoing by the company but said it decided to settle the dispute with AMD to avoid the risk of a triple-damages finding by a jury.

I believe the fact that Intel knew they were guilty along with the expectation that they would be found guilty along with an expectation of a fine in the range of 4.0-6.0 $BILLION$ convinced Otellini to settle.
