That is so unfounded its ridiculous. The SEC has the right to suspend under suspicious circumstances only and makes their decision to go forward pending the outcome of the investigation. What do you think the SEC is above the constitution and has the right to accuse a company of being guilty without said company having the right to defend itself? How ridiculous would that be, if they ever did come out and claim that before due process and the company turned out to be legit the SEC would be liable and the lawsuit against the government would be astronomical. You have no clue what you are talking about.
