Several law firms have announced filing class action suits however I think you'd be hard pressed to pursue a lawsuit simply because a company failed to file it's financial statements on time.
In the case of SPNG, I think you have seen the last of the 10K's. Enough time has passed since the company disclosed it's auditors had begun re-auditing past years to where I feel very safe in saying that it is lack of will and not ability that has kept the process from getting at least the first re-audit filed.
