it may be that the sec did get a subpoena but you have no facts that it was done because spng was being uncooperative..thats just what you wish to believe..it is not a known fact...

generally the SEC issues subpoena's for what they require
( important docs ) in ongoing investigation .. but! they normally do list certain required docs and ask for them volitionally .. its part of the fishing opportunities ... the company can' protest

the sec can be very pesky and deadly .. especially if a wells notice is given and the company responds with the “Wells Submission.” The SEC can go back to day one and catch them in a slip up or story change or lie or mistake. In a formal investigation one of the first thing they request is all company emails ( by subpoena )
