MM, I don't disagree w/you and I believe RS is capable of damned near anything (except for competently running a pharma company :). My point is that in bk court the scope of jurisdiction is ltd (it's not a criminal court). On this note I think the "stewardship" of XKEM by RS and SB s/b evidence enough that any further involvement by them could not possibly be in the best interests of the co.

In a phrase: their track record speaks for itself.
