Can anyone come up with a scenario in which the SEC finds evidence of a massive naked short position and yet does nothing?

Because I really cannot believe that the SEC wouldn't have seen it if it was there. And if it isn't there, then doesn't that suggest SPNG might in fact have a very high O/S? And doesn't it raise a lot of other questions about the stories being told?

So, under what circumstances would SEC see evidence of a massive naked short position and do nothing?
