1. From the "Biofrontera Agreement", "the Registrant's (DNAP's)payment obligation does not begin, until after the effectiveness of a registration statement to be filed..."
2. "In the event that such registration statement does not become effective on or before February 7, 2005, the Biofrontera agreement will terminate without liability to either party".
3. I also recall Gabriel being quoted as having said in July or August of 2003 that it would take about a year and a half to two years before the world recognized what DNAP has. One and a half years from August 2003 would take us to February, 2005.
In light of this information and the fact that DNAP has started 20 clinical trials in September and at the current pps the $35,000,000 purchase of stock by Dutchess would buy almost 2 billion shares of stock (of which there isn't a sufficient amount still in the corporate treasury), it seems to me that a good case can be made for some significant news between now and February that will lift the share price, reduce the potential dilution and start us on a long term trajectory of a rising price.
Anyone out there share similar thinking?
