If we get the 10k it will still go to the Grey Market to start but if the 10k is good news it wont take long to return to the Pinks.

Yes it will because you are still under SEC investigation even when the 10 day suspension is lifted. IMO No mm is going to file a form 211 while that is still hanging out there. 10K or no 10K.
