In their subsequent suit, Scanbuy claims NeoMedia is both infringing on Scanbuy patents by not using the NeoMedia method and the NeoMedia patents are invalid under USPTO rules.
If both suits are settled, then all of this goes away and the two companies will share the necessary IP in any number of possible arrangements.
While both companies own indirect barcode processing patents, they are supposed to be distinguished by the specific steps required to meet the patent claims. How each company has actually been processing their barcodes will be part of the discovery.
After the Neustar deal, it will be safe to say NeoMedia is complying with their patent portfolio claims. Considering Scanbuy handles their own processing, no one outside the company really knows how the hand off really happens. If the lawsuit goes forward, we will get a glimpse into it.
