temp luvs amy, I received an unsolicited phone call from Peter Tobia. Apparently he was upset about my posting of the SEC. He kept telling that me he"was a man" and that if I had any questions about ORRV, I should ask him. "man to man". Well a funny thing happened during that phone call. I kept asking him questions about the wreck in Panama and he refused to answer any questions unless I signed a non-disclosure agreement. I'm not going to tell you what I told him to do to himself, it's too rude. When I mentioned to Mr. Tobia that maybe I should
contact the SEC with this information. Mr. Tobai became very irate and told me to do whatever I wanted. Mr. Tobia, be careful what you wish for, I just might have done that after our phone call.

Anyway, I am now going to pose some questions for Mr. Tobia, since he is the spokesman for ORRV. temp, you run a business and know a lot about stock. I would appreciate it, if you would tell us what you would do about some of the questions I pose?

Mr. Tobia seems real upset about my posting about what I thought was an SEC violation about inside information. He kept asking me, if I was a legal expert.

The SEC adopted new Rules 10b5-1 and 10b5-2 to resolve two insider trading issues where the courts have disagreed. Rule 10b5-1 provides that a person trades on the basis of material nonpublic information if a trader is "aware" of the material nonpublic information when making the purchase or sale. The rule also sets forth several affirmative defenses or exceptions to liability. The rule permits persons to trade in certain specified circumstances where it is clear that the information they are aware of is not a factor in the decision to trade, such as pursuant to a pre-existing plan, contract, or instruction that was made in good faith.

Mr. Tobia, A convicted scam stock promoter also sold $26,000 worth of ORRV stock to investors in January. The stock he sold, came from ORRV, it was not his personal stock. This stock promoter was supposed to turn over the money to OPERATIONS MANAGER - Steve Elchlepp in Key West. The scam stock promoter kept $16,000 for his personal use and gave $10,000 to Steve Elchlepp. Steve E. never reported to ORRV, that he received this money.The $10K went into Steve E's. personal bank account. I know that,because Operations Manager Gerry Edwards told me that he and the officers at ORRV had no idea that stock was sold for operation expenses and the money that Steve E. received was NEVER reported to the company. I sent copies of documents to Gerry Edwards showing the money transfer to Steve Elchlepp. MR. Tobia, I'll post some questions for you, at the end of this post.

I have in my possession an e-mail from one of the ORRV Operations Managers that states that ORRV is going to Panama to salvage a Spanish Shipwreck called the San Jose. This wreck sank in 1631 and was partially salvaged at the time of its sinking. The same e-mail stated that ORRV was doing this salvage with a treasure salvor in Panama named Robert McClung.
I also have in my possession an ORRV document called " Crosswinds Project ". In which an unnamed Almiranta Spanish Treasure ship is CURRENTLY being salvaged in Panmana by ORRV/RS OPS. The document shows pictures of coins and pewter plates that have been salvaged. The document goes on to tell of the wreck being partially salvaged at the time of its sinking. Oh, I forgot to mention that a famous researcher and treasure hunter claims that he has the permit for the San Jose sunk in 1631, and that he HAS NOT given ORRV/RS OPS. permission to salvaged anything from this wreck.

Now for my questions Mr. Tobia

1. Does ORRV/RS OPS have a permit to salvage the wreck that is
listed in the document "Crosswinds Project"?

2. Does ORRV have ANY permits to salvage any wrecks?

3. Since ORRV is a publicly traded company and RS OPS merged
with ORRV. Do you consider information that was contained
the e-mail I have a copy of from one of ORRV's operations
managers ( from several months ago) mentioned ORRV going to
Panama to salvage the San Jose, inside information that was
not made available to the public? Do you also consider the
information contained in the Document "Crosswinds Project"
Information that WAS NOT released in a Press Release to
the general public, inside information?

4. Is the Robert McClung that ORRV/RS OPS is working with in
Panama the same Rob MCClung
that found and salvaged the Capitana in Ecuador?
The same Rob McClung that I saw a TV show documentary made
Ecuador, where the Government of Ecuador "KICKED" Rob
McClung out of Ecuador for what they termed, "Stealing
Treasure" that he did not report finding to the government?

5. Do you consider the $10,000 that ORRV Operations Manager
put into his personal bank account, that was supposed to
be used for ORRV expenses, without telling the company
that he received those funds. Misappropriation of Company
Funds?

6. Have you recovered those funds from Mr. Elchlepp? Have you
recovered the $16,000 from the convicted scam stock
promoter and if not, why not?

7. Lastly, do you think it is legal for an Unlicensed scam
stock promoter to sell ORRV stock for the Company?


temp luvs amy ( Or anyone else 0 If you owned a company any an employee received $10,000 of company funds and put them in this personal bank account and NEVER reported it to your company. Would you think he did anything wrong and what action would you take?
