It’s true. “Bottom line is, nobody is holding a gun to anyone's head forcing them to do anything.” But IHUB takes an active part in the content of the site – dictating what may or may not appear. That may create a responsibility – I don’t know and was asking the board.

The TOU creates a fiction that there are rules and rights of users and members. There is an expectation that content, which violates the TOU, will be removed and content which does not will stay. In actuality, IHUB does not agree to enforce its TOU – it is discretionary on its part. The person ultimately in charge of what is, and is not, enforced is Matt. Given this broad authority, everything, which can be seen on IHUB, and everyone who posts here, is under Matt’s control.

The TOU also makes this clear:
“iHub does look at messages posted by its members. We do reserve the right to monitor or remove any post, at any time, which is in violation of the User Agreement or clearly detracts from the value of the community, without notice. We also reserve the right to terminate any member's membership at any time, without notice or refund.”

People DO take the information and opinions on IHUB as part of their investment decisions and IHUB knows this. Whether a lawyer could convince a jury and legal system this is true and that IHUB has a responsibility or should have exercised more responsibility remains to be seen. My point was that this task might very well be made easier if the “TOP” decision maker was charged with criminal offenses and the nature of which involved his position in IHUB. ADVFN’s knowledge and consent involves them.
