So, how does a NSS continue shorting with the SEC investigating again?

Can anyone elaborate on this faulty logic?

So, we have an alleged NSS, and we know for fact the SEC is involved with SPNGE, but the NSS continues to short and "hold us down"?

How, in pray tell, does this work? Can anyone explain? Are the NSS that brazen? Are the NSS that stupid?
