I don't believe their shares are still restricted. JD, Glenn Harris, Karl Malone and whoever else had restricted shares, but I believe the restriction is off now. A restriction is only for a year on pinksheets (6 mo on OTCBB and higher). They may have MORE shares that are restricted, like the pfd shares that JD tfrrd to common, but not the original 300 million or so. Obviously they haven't sold, or we'd see the filed Rule 144 forms, but according to this post below, they were restricted in 2007, meaning that they were tradeable in 2008. And believe me, I am very impressed that they're holding them for much bigger and better than where we're sitting now, and hopefully for multi pennies and higher.
