First off EDS has the best lawyers and they probably did this scan of possible infringements long ago before partnering up with EVRM. I this this is not a valid point. They would have done their DD even before talking to EVRM that is how most big corp do it. They would be continuing their DD for this while they arestarting and working with them. I think they would just be monitoring the patents now so I do not see this as a problem.
Second on finances - if I have been told properly from the company this would not be a problem. All they would have to show them their private investors. It is my understanding they have tremendous financing from private people. I am not allowed to know who they are but I am sure in an NDA with EDS they showed them that.
So on all of your points I disagree with you. question what is your background??
