EI replied back to your questions yet?

I'm not too worried about the 10-K it fell into the "bad" classification but we all new it would be in the "bad" bucket..

At least this allows us to uplist per FINRA and hopefully we get some news that EI has not been able to release while under the FINRA umbrella.
