The first filing they are referring to is for the 2009 notes.

The second filing they are referring to is for the accelerated portion of the 2008 notes.

It says it black and white. Sealed 8k/a on 4/6 which is the 2009 notes. And a sealed 8k/a on 6/5 which is the acceleration agreement on the 2008.
