Agreed. Unless there is a settlement they are working on, the judge really needs to make a decision. There is no question whatsoever that the 4 bil should undisputably and lawfully go to Wamu. That is clear cut. If the judge grants discovery then its off to the races for us. At that point it will be in JPM and FDIC's best interests to settle ASAP.
