Good question. My thought is that patents don't preclude others from conducting research but that economic gain derived from the protected IP is protected. So if Bill Gates wants to feed a bunch of sick kids free transgenic milk there isn't much GTCB can do about it. Not that they should.

But hey, I'm not a lawyer...
