Rambus and Hynix agree on licensing terms

Rambus, a company which specialises in patents and law suits, today said it had agreed to the terms of court-ordered, compulsory licensing fees with Taiwanese memory maker Hynix.

Hynix will have to lap up rates of one per cent for SDR SDRAM and 4.25 per cent for DDR SDRAM memory chips for net sales between 31 January 2009 and 18 April next year. Rambus has also proposed to the court that Hynix should shell out $349 million in damages, plus interest of around $48 million, depending on when a verdict is delivered and the case finally closed. A court had previously told Rambus to sit down with Hynix and work out a licensing scheme.

“While the Court still needs to resolve some outstanding issues, we are pleased to have reached agreement with Hynix on a number of terms,” said Rambus' senior vice president Thomas Lavelle. “Our goal, as always, is to seek fair compensation for the use of our patented inventions, and this agreement will be a significant milestone in pursuit of that goal.”

Rambus said Hynix, which filed the case back in 2000, had lost it on all counts. The company believed Rambus had broken the antitrust Sherman Act and had acted like a deceptive little snitch. Memory makers around the world entered into lawsuits against Rambus ages ago, accusing the US company of taking part in JEDEC meetings aimed at defining industry standards and secretly patenting stuff behind everyone's back.

The most recent Supreme Court ruling says Rambus is as innocent as OJ Simpson. It turns out Rambus had the better lawyers. Rambus is also famous for its rather annoying shareholders, dubbed Ramboholics, who enjoy sending flattering emails and comments to hapless journalists.

Doubt this guy is paid by the cartel to put a negative spin on the news. Think his attitude is representative of the anti-Rambus crowd in the tech industry. This group will always have an issue with Rambus, and who cares?

Rambus will be wise to build relationships with those journalists and IT groups that are more objective and willing to reconsider their past bias.

Just my opinion.
