I played a lawyer in a courtroom once or twice but I don't do that anymore. I don't know how far back you need to go if you file in the next few months. You will probably only be able to reach the current board anyway. There are probably a number of estoppel defenses that will keep you from going after the previous boards. However, the money is in this board anyway. The $5M Acacia deal gives you at least something to base your damages off. Remember, you can be right as rain but if there is no harm (provable damages) there is often no foul.

Honestly, I wish you luck. If you proceed you are going to get a butt-load of information from discovery about what actually happened. I know I will never see it (unless it comes out in court papers) but it will be nice for once to see some justice for the shareholders of this company.
