penny, yes they are, but until litigated to resolution, it is not... often they go away behind closed doors and work out fine...companies don't usually feed investors with all of the details of any lawsuit because until terminated, the outcome is unknown.... they don't always harm a company.

I'm sure we'll get full disclosure as necessary when the time is right here too..... the silliness of the ExerGerm suit is just that.....
