Well , not really.

"A party may challenge the validity of a patent in a federal court, or through reexamination before the U.S. Patent and Trademark Office (USPTO), or both. If the validity of a patent is contested in a federal court, the judge determines validity if there is no factual dispute. Otherwise, the jury decides validity."
