You can't start a class action on the "possibility" of a scam. It would have to be clear that is was a scam with documented evidence.

And let's say for the sake of argument that you do have documented evidence of a scam. Class action lawsuit against a company that has no revenue will not likely lead to you getting your money back. Not to mention the expense of litigation.
