If AMD wants to obtain the benefit of the 2001-2010 License Agreement during the running out period of the patents it will have to continue to meet the terms of the Agreement. Therefore, TFC will have to remain a Subsidiary for AMD to use the license to cover the TFC foundry manufacture.

Any third party foundry would be subject to the foundry limit, apparently 20%, that exists in the current Agreement.
