Could have he just avoided the RS by raising the AS? Possible, but he'd have to raise the AS to such a level where he couldn't possibly expect the market to support the conversions. So... was RS necessary? Sadly yeah... You can only dump so much and have any hope of support at 0001.

Could the Es be used to pay? I honestly don't know. The Es carry a degree of voting power and I wouldn't want YA to have that sort of power. Could have he sold the Es and paid YA? Sure, but the dilution would have been there from the Es and not YA.

Would I have gone back to YA? No. I would have went elsewhere.

Did the lawyer miss Cadent? Yeah, sure did. Why? Well, when GS had GSCR, everything was in total disarray and no one really knew where anything way. (Keep in mind, KK is an idiot and cannot manage capital; as we all know...) Now... did KK know Cadent was in GSCR when he sold the shell to TS? Honestly I don't know since I am not KK (thankfully). Part of me thinks KK did know about some form of debt being in there, but that's a WAG and a personal opinion.

Was there fault? Sure. I won't discredit fault. People screwed up, TS took a rather insane amount of CD and misjudged the OTC environment. That really screwed everyone and here we sit. So... since I don't have a time machine, I cannot change it. I would if I could, but I cannot.

As for the issue of choice, we all have free choice. Sometimes it allows crappy decisions to be made, sometimes not. I'll be blunt with you, I took a hosing on a good portion of shares since I am 5M post RS. So.. Yeah, that does suck royally. But I chose to stick it out... Will the 5M pay off? I don't know. Perhaps someday once all this disaster is cleaned up, but that's (IMO) a good year away.

As for lockout, that's the DTC and broker -- they handle that, not the company. RPT reported on that nicely and was correct. I called around and dug the same result up. Did it suck? Yeah, being screwed by a lazy DTC and broker isn't on the top of my "fun" list... Was it illegal? I don't know. I tried to look up the law regulating DTC but cannot find the proper code. (I tried...)

So... what to say? Dunno. I am here like you. But I choose to make something of it while I wait to see how this plays out.
