This is what I've been saying. In criminal law, fraud is the crime or offense of deliberately deceiving another in order to damage them. By damaging them the offender obtains property or other value from the victim.
MP should not be allowed to do what he does. Red is right when he states that the disclaimers protect these pink CEO's. BUT, he could absolutely be criminally prosecuted for fraud on the public if so proven. IMO
