There is no where in this agreement that Opp states that it will not provide adequate sewer for industrial waste. Since PRGL is held harmless in this agreement, its the City of Opp that has to take the hook!

PRGL should be able to dump waste on its site and be held harmless until the city of Opp gets its act together and builds the proper sewer lines. Its the city of Opps mess as they knew they were at or near capacity, they should have planned and built a proper extension to the sewage plant as they knew that a 60 million gal/year bio plant was being built!. Any engineer would know that a bio plant has discharge needs, so its the City of Opps engineers that are to blame for not providing the necessary infrastructure in a "Time is of the essence matter"

If the sewage line is too small, or sewage treatment capacity is not there, thats not PRGL's problem! PRGL is held blameless, as per the agreement!
