ARP/APP admits that "Opp's sewer treatment facilities are operating at near-capacity the city knows it cannot provide industrial treatment and did not offer it!". Hello ARP/APP, I see a weak link in the city of Opps armour right there!

If the City of Opp is widely known to having problems why hasnt it done anything about it?

The City of Opp and Covington county are required to;

4.Opp agrees to provide water, sewer, natural gas and electrical utilities to the boundary line of the above site at no charge to Perihelion and will waive tap connection fees on all city utilities...

Opp further agrees to hold Perihelion harmless from any environmental hazards created prior to execution of this agreement
(so if the sewer isnt properly installed, its Opp thats to blame as Perihelion is held harmless! Its Opp that has to make sure everything happens. As long as Perihelion applies for the ADEM permit, its Opp that agrees to hold Perihelion harmless until proper sewage lines/approvals are in place. Its Opp that has agreed to take the blame, not Perihelion!)

17. Time is of the Essence-Opp agrees to work diligently, weather permitting towards completing the site preparation specified above as soon as necessary. (PRGL is trying to operate without proper sewer, so Opp has not complied with the Time is of the Essence clause!).
