I am no tax expert, but aren't we taxed higher for stocks held short term vs long term? If one sells now for the tax write off and then buys back in January, then you sell next spring when we see big moves in the share price, aren't you going to be taxed at a higher rate than if you would if you had just held the shares, making them "long term capital gains"?

Not sure how the math works on this, but just a thought.
