I`m not that sure about Asia, but I think the court system is similiar. It`s difficult to describe, I don`t know if you know the basic differences between US and european court system? One exampel Is the Clyw patent, If Clyw clain patent for someone like Birdsteps use of seamless roaming, then CLYW claim the patent for the idea of seamless roaming, since ASNAP has nothing to do with the methods used in Birdstep Mobile IP Client. In Europe you can`t claim patent for an Idea, so this patent would probably not have been accepted in Europe with same use of words, beacuse the Eurpean court system won`t tolerate patent on this use of an idea that existed long before CLYW claimed the patent. But i don`t know about Asia and America, but in US I`m totally open for CLYW winning, beacuse the american court system i believe can be more patent-focused, and it`s no secret that US have a whole other story when it comes to lawsuits!
