Here's the latest (06/05/2008) on the Aeropostale / Barnes & Noble case:

Judge Joan B. Gottschall granted the motion by Plaintiff Card Activation Technologies, Inc. and Defendant Aeropostale, Inc. for entry of scheduling order. Fact discovery was ordered closed by 9/30/2008. Parties to exchange proposed claim terms by August 29, 2008, or 45 days after Magistrate Judge Valdez issues ruling (Markman hearing in Walgreen’s case). Parties to meet on claims terms 9/12/08. Parties to file opening Markman briefs by 9/26/08. Parties to file responses by 10/24/08. Parties to exchange expert reports after the court issues a Markman ruling (Aeropostal / B&N case). Parties to exchange response expert reports 30 days thereafter; Expert discovery including depositions shall be completed 30 days thereafter; Dispositive motions shall be filed and noticed up for hearing 14 days thereafter.

None of the above influences the timing of the Markman ruling by Judge Valdez in the Walgreen's case, which will happen any day as the judge has had the information in consideration for about six weeks now..... However, once judge Valdez rules, then that does trigger the timeline for the Aeropostale / B&N case as described above.

Access is free, but you need to sign up with a credit card, as you will be charged 8 cts/page for any court document you retrieve. This includes the case history (which for the two most advanced cases now runs at 40 cts each update) and any filed documents (which mostly are not worth retrieving except for significant rulings like the March ruling in the Aeropostale/B&N case.).
