"To our knowledge, none of our directors and executive officers has been involved in any of the following proceeding during the past five years: (i) any bankruptcy petition filed by or against any business of which such person was a general partner or executive officer either at the time of the bankruptcy or within two years prior to that time..."
And, oh yeah, also from page 38:
"Dr. Adya Tripathi, who served as Tripath’s chairman and chief executive officer since its inception in 1995, resigned shortly after Tripath filed its voluntary petition for relief under Chapter 11 of the Bankruptcy Code with the United States Bankruptcy Court for the Northern District of California on February 8, 2007."
