This situation is FAR from appropriate, and should never be allowed. This situation not being a TOU violation does not make sense at all. The motive is clear from anyone who is moderating a board while sueing the company of that board...it will cause MAJOR problems for IHUB if you let it continue. Especially if IHUB is aware of the lawsuit, and does nothing to stop the moderators obvious agenda...Trust me...its not worth it to allow it.
