Schering and/or Schering Plough (mixed reports which I haven't sorted because it isn't of interest to me).

they had excess cash and started buying back stock (and buying it back as the short interest increased thus in effect buying from shorts)

Can't dispute that strategy if you know your stock is being abused - but with perfect 20/20 hindsight I am not sure I would do that with a lifestyle drug. Too much randomness. As errors in judgement go - not a huge one IMO.

The real interesting questions that could be answered looking at this episode are how open management was - e.g. did investors only know of the issue after the FDA did something unpleasant to the company. Note that I haven't figured out the exact timeline yet - but the FDA pushed back at least 2 times (they required an animal trial, then another animal trial) and it would reflect very well on the company if the company had already released some of that causative data before receiving notice from the FDA.
