Willens issued a statement on iHub clarifying why the Shotpak website was down for several days:
"Because the board felt the site was compromised by certain members of the previous management, Shotpak moved the site to a new hosting company. This, as well as the website’s re-design, was the reason the site was inactive for several days."
Therefore, my previous assumption that it was down due to late payment to the host is apparently incorrect.
However, Willens, claiming to represent Shotpak's Board, threatens both me and iHub with legal action if I don't remove my prior posts and cease negative commentary.
I believe the action threated by Willens would qualify as a "SLAPP" or "Strategic Lawsuit Against Public Participation." California has particularly strong sanctions against such lawsuits -- so called "anti-SLAPP" rules.
Because I believe that Shotpak, Inc. continues to be misleading in its press releases (in the description of the current company) and on its website, and that this threat by its General Counsel seems intended to intimidate me into a lack of public participation in discussion of this stock, I do not plan to comply with the demands made by Willens in his post.
I will have more comments later.
