Which other advices can he give him than: 1. to contact PNMS again and to try to solve the problem directly with them (in a rather constructive kind of solving approach), 2. to try it "the hard(er) way" with inclusion of his attorney ? You and me, we both don't know exactly what happened concerning the "midas case". I always prefer to hear the point of view of both sides before making my judgement - if this is not possible I make no judgement...
