I believe it is, however there are many sections and I am not real familiar with the specific ones that are checked off on this particular filing and exactly how that relates to a possible merger.

If you look at the form filed the first 2 boxes are checked.

Rule 12g-4(a)(1)(i) x
Rule 12g-4(a)(1)(ii) x

Those sections of Rule 12g-4(a) are the relevant ones ... hopefully someone with more expertise in this area can elaborate.
