Gunderson may have actually filed an appeal of the ALJ's ruling within the 21 days allowed, and maybe the SEC commissioners (or their staff) will review the appeal of that ALJ ruling.

That, of course, means he'd have had to file his Petition for Review by 10 January. Given that, you'd think it would have appeared on the SEC website by now, if the petitions do appear on the site.
