MD: In the unlikely event there is a submarine patent trolling LTC waters, its clock of opportunity is ticking, unlike pre 1995 scenarios. After 1995, of course, the rules changed: the 20-year term of a post 1995 patent begins on the application filing date, not the date of issuance. Under both American and E.U. rules, most patent applications must surface after 18 months, thus more or less depth-charging submarine patents altogether.
