I believe the only time they can't use your shares to short is if you order the certificates for them which takes them off the "street". And nobody does this because then you have to mail them back to your broker before you can sell your shares. To troublesome.

Granted, I haven't been active for a number of years, but I believe the MM's having to "cover" by the end of the month is also an old wives tale. It's just not true.
