not true...you are thinking about ex divy date...company sets the record date..but in this case, they just never bothered to announce until too late...they butchered it.

"Date, set by the issuing company, on which an individual must own shares in order to be eligible to receive a declared dividend or capital gains distribution. The date is also used by the NASD to set the ex-dividend"
