As far as I am concerned, Kmart when filing Bankruptcy did not file to include their real=estate holding. Only their debt obligations and invested employees and outside investors. Thereby sticking it to the little people. By filing BK, they were allowed to re issue new stock by nullifying prior stock and walk away with those monies. Then usuing the undelcared re estate, issue debt free assets as collatereal for new stock which they put on the market for around $20.00 plus/share and made out like bandits. Also in doing this the new board of directors voted themselves 34 mil dollars for bonus's for doing such a super job. They got 34mmil..Employees got NADA
