EFF filed for an "ex parte" reexamination. Ex parte reexaminations may be initiated by any member of the public, but once they submit their request, they no longer actively participate in the proceedings. The correspondence is strictly between the examiner and the patent owner.

The chart you linked is to the site of patent law firm, and that law firm is obviously advocating for potential clients to choose a more lawyer-intense inter partes reexamination.
