Isn't this illegal?

Had an order in for CXPO at 9.43

MM apparently took some shares @ 9.41. After reading through the rules my understanding is if the MM steps in front of me he has to beat my price not execute 2 cents below it.

I despise MM's and consider them crooks blah blah blah already but how the hell do they get away with something like that? Is there a formal process to complain?

When posting on VMC boards all postings should have a symbol in the header and if foreign please post both US and Foreign symbols.
