You don't need to be a current shareholder to complain. Those who have bought or held based on statements made by management have a legitmate gripe, even if they have since sold for a loss and are no longer holding.

I bought in 2000 based on the "global standard OS" and NASDAQ listing statements. While holding the PPS continues to drop and I began to doubt whether NAZ would list. I sold at basically break even on a brief pop when the share price, so no loss to claim.

The more shareholders who write in, the more likely it is to get the attention of the very busy SEC. It's important to give them your full name and contact information. enforcement@sec.gov

If there has been any decption or wrong doing, disgorgement of ill-gotten gains is always a possibility.
