According to SEC rules a company has a right to be "silent" if you will. Companies are under no obligation to disclose everything. This situation is probably complicated and it is not the right time for XKEM managment to disclose anything until they know what is going on and determining the impact to the company. I feel better thinking this way then the other way such as BK or screwing the shareholders and going private.
