You signed an agreement when you opened up your account, (SDA) and in that agreement you agreed to go to arbitration if there was a dispute with the brokerage. If one tries to go through any other route to recover funds it will be shot down before it starts because you have a contract with the brokerage.
Now in arbitration you have to show where the brokerage has damaged you or else the arbitration board will not even consider your case. Since your complaint is against the brokerage, and they say that your shares are good, but just unable to trade because of the freeze that TM has been unable to thaw, the arbitration board will throw out your case and you could be liable for all legal costs.
This looks to be finally done and I hope TM doesn't get 1 cent more until he works this situation out, which i doubt he will.
