Tifford did a good job in court , RA took the fall . he is no longer with the company and owes over 2 mill payable in monthly instalements over a period of 20 years ..i think he also lost his condo worth 600-800 grand

the SEC will never let it get to a jury ...never . the presedent it MIGHT set for thousands of other companies to emulate is too risky ,so that even a minuscule chance is too much for SEC to take .If the appeal is accepted ( gunderson thinks he will eat the SEC alive in the appeals court )then USXP pushes the SEC back to a jury trial ..in other words the SEC will cave and settle if USXP gets the appeal .
getting the appeal accepted is the primary step .it should be as important as the 700 mill judgement ..these small steps going forward are necesarry for survival .meanwhile Moscowitz will destroy the remains of USXP
I wouldnt settle ..the SEC needs to pay up and pay up big time ,with interest the 700 mill lawsuit is closer to a billion if not more.
