Patent infringement notifications...

Personalizit, you got me thinking about the PR you referenced below:

"BP&G partner Jeffrey A. Pine said his firm has identified and obtained product literature and other information about hardware, software and systems vendors who would be motivated licensees of NeoMedia's patented technologies."

One could also read this as they have obtained a list of vendors who may already be in violation or who have definitively infringed upon NEOM's patent.

Think about this. All current plantiffs (Virgin, L-Scan, ScanBar and AirClick) were "previously issued" written notifications from Baniack & Pine regarding patent infringements. This is the reason why NEOM is seeking treble damages as well as cease and decist orders...because they were all forwarned and none of them responded.

I wonder how many other hardware, software and systems vendors have been issued notices from Baniack & Pine that we have not heard about yet? It could be a whole "data base" worth as alleged in the PR above. I suspect there will be a host of treble damage suits to be filed in the near future.

All we need is a "LandMark" suit (specifically NEOM vs. Virgin) in which NEOM wins hands-down, provided it isn't an out of court settlement. Then all subsequent suits will refer back to the recorded LandMark suit as a barometer in gauging how to intrepret or decipher the law for these specific patent infringements.

I believe these rulings will be in favor of the plantiff (NEOM) and against all other defendants including LScan, AirClick, ScanBar, VeriSign, etc. You got to love this stuff. All the Best, JP
